BY SUBMITTING PERSONAL INFORMATION, YOU AGREE TO RED COUCH’S COLLECTION, USE AND DISCLOSURE OF SUCH PERSONAL INFORMATION FOR THE PURPOSES DESCRIBED IN AND IN ACCORDANCE WITH THIS PRIVACY POLICY AND AS PERMITTED OR REQUIRED BY LAW. Subject to legal and contractual requirements, and reasonable notice, you may refuse or withdraw your consent at any time by contacting us as described below. If you refuse or withdraw your consent, we may not be able to provide or continue to provide services and information which may be of value to you.

At Red Couch we make privacy a priority. We will not sell or rent your personal information to third parties for their marketing purposes without your explicit consent. Please read this privacy policy to learn more about the ways in which we use and protect your personal information.

Overview

The privacy practices of this statement apply to our services available under the domain screenlight.tv and the unique URL that will be chosen by you upon signing up for our services (“Site”). By accepting the Privacy Policy and the terms and conditions for use (“Terms and Conditions”) in setting up an account, you expressly consent to our use and disclosure of your personal information in accordance with this Privacy Policy. If you do not agree with the Privacy Policy or the Terms and Conditions please to not use or access our Site.

1. Children

The Site is not directed to children under the age of 16, and we do not knowingly collect personal information from children under the age of 16 without obtaining parental consent. If you are under 16 years of age, then please do not use or access the Site at any time or in any manner. If we learn that personal information has been collected on the Site from persons under 16 years of age and without verifiable parental consent, then we will take the appropriate steps to delete this information. If you are a parent or guardian and discover that your child under 16 years of age has provided personal information, then you may alert us as set forth in the “Accountability” section and request that we delete that child’s personal information from our systems.

2. Information We Collect

Our primary purpose in collecting personal information from you is to provide you with efficient and customized video project management services. This allows us to provide services and features that most likely meet your needs, and to customize our service to make your experience safer and easier. We only process personal information about you that we consider necessary for achieving this purpose or when the processing is carried out in our legitimate interests, which are further explained in the “Our Use of Your Information” section. We may also process personal information upon your consent, asking for it as appropriate.

If you choose to use our Site and our service, we may require you to provide contact and identity information, billing information, shipping information and other personal information as indicated on the forms throughout the Site. Where possible, we indicate which fields are required and which fields are optional.

We use your financial information, including credit card information to verify the accuracy of your name, address, and other information, as well as to bill you for your use of our services.

We automatically track certain information about you based upon your behaviour on our Site (including cookies subject to our Cookie Policy). We use this information to do internal research on our users' demographics, interests, and behaviour to better understand, protect and serve you and our community. This information may include the URL that you just came from (whether this URL is on our Site or not), which URL you next go to (whether this URL is on our Site or not), your computer browser information, and your IP address.

If you establish a credit account with us to pay the fees we charge, we collect some additional information, such as: a billing address, credit card number and credit card expiration date and tracking information from cheques or money orders.

When you post comments, videos or other information (“User Content”) on the unique URL that is chosen by you we retain this information only for the purposes of sharing it with other authorized users involved in a particular project. You are free to add to, edit and delete the User Content at your own discretion.

If you send us personal correspondence, such as emails or letters, or if other users or third parties send us correspondence about your activities or postings on the Site, we may collect such information into a file specific to you.

3. Our Use of Your Information

We use your personal information to facilitate the services you request and use. We use personal information in the file we maintain about you, and other information we obtain from your current and past activities on the Site to: resolve disputes; troubleshoot problems; bill your account; measure interest in our services, products, services, and updates; customize your experience; detect and protect us against error, fraud and other criminal activity; enforce our Terms and Conditions; and as otherwise described to you at the time of collection, use or disclosure. We may compare and review your personal information for errors, omissions and for accuracy.

If you provide us with credit card or other financial information we use your name, address and financial information to bill you and provide associated support.

You agree that we may use personal information about you to analyze Site usage, to improve our content and product offerings, and to customize the Site's content, layout, and services. These uses improve the Site and better tailor it to meet your needs, so as to provide you with a smooth, efficient, safe and customized experience while using the Site.

4. Our Disclosure of Your Information

As a matter of policy, we do not sell or rent any of your personal information to third parties for their marketing purposes without your explicit consent. However the following describes some of the ways that your personal information may be disclosed in the normal scope of business to provide our services. When we disclose your personal information to third parties, we take reasonable measures to ensure that the rules set forth in this Privacy Policy are complied with and these third parties provide sufficient guarantees to implement appropriate technical and organisational measures.

Other Users on the Site: We share your user ID, name, email address, comments and video and other material posted to the Site with other Users on the Site who are involved in the same project to facilitate the purpose of the services that we offer.

Internal Service Providers for Our Operations. We may use third parties that we refer to as internal service providers to facilitate or outsource one or more aspects of the business, product and service operations that we provide to you (e.g. cloud infrastructure hosting, support software, mail deliverability, real-time notifications, application logging, business analytics, payment processing, recurring billing) and therefore we may provide some of your personal information directly to these internal service providers. In some instances, the internal service provider may collect information directly from you. In these cases, you will be notified of the involvement of the internal service provider, and all additional information you provide them and their additional uses will be strictly up to you. If you provide additional information to an internal service provider directly, then their use of your information is governed by their applicable privacy policy.

Legal Requests. Red Couch cooperates with law enforcement inquires, as well as other third parties to enforce laws such as: intellectual property rights, fraud and other rights, to help protect you and the community from bad actors. Therefore, in response to a verified request by law enforcement or other government officials relating to a criminal investigation or alleged illegal activity, we can (and you authorized us to) disclose your name, city, province, telephone number, email address, UserID history, comments and other history of your activity on the Site without a subpoena. However, in an effort to balance your right to privacy and the ability to keep the community free from bad actors, we will not disclose additional information to law enforcement or other government officials without a subpoena, court order or substantially similar legal procedure, except when the additional disclosure of information is necessary to prevent imminent physical harm or financial loss.

Due to the existing regulatory environment, we cannot ensure that all of your private communications and other personal information will never be disclosed in ways not otherwise described in this Privacy Policy. By way of example (without limiting the foregoing), we may be forced to disclose personal information to the government or third parties under certain circumstances, third parties may unlawfully intercept or access transmissions or private communications, or users may abuse or misuse your personal information that they collect from the Site. Therefore, although we use industry standard practices to protect your privacy, we do not promise, and you should not expect, that your personal information or private communications will always remain private.

5. Your Use of Other Users' Information

In order to facilitate interaction among users of our services on a particular project, our Site provides you with limited access other users' contact information and full access to video material and comments posted to the Site.

By entering into our Terms and Conditions, you agree that, with respect to other user's personal information that you obtain through the Site, Red Couch hereby grants to you a license to use such information only for the purpose of commenting on the video materials posted to the Site and facilitating the project related thereto. In all cases, you must give users an opportunity to remove themselves from your database and a chance to review what information you have collected about them. In addition, under no circumstances, except as defined in this section, can you disclose personal information about another user to any third party without our consent and the consent of that user. You agree that other users may use your personal information to communicate with you in accordance with this section. Note that law enforcement personnel and other rights holders are given different rights with respect to information they access.

Red Couch and our users do not tolerate spam. Therefore, without limiting the foregoing, you are not licensed to add a user of our services, to your mail list (email or physical mail) without their express consent.

6. Use of Email Tools

You may not use the email services or other communication services that we offer to send spam or otherwise send content that would violate the Terms and Conditions.

7. Control of Your Password

You are responsible for all actions take with your User ID and password, including fees charged to your account. Therefore, we do not recommend that you disclose your password to any third parties. If you choose to share your User ID and password or your personal information with third parties, you are responsible for all actions take with your account. If you lose control of your password, you may lose substantial control over your personal information and may be subject to legally binding actions taken on your behalf. Therefore, if your password has been compromised for any reason, you should immediately change your password.

8. Accessing, Reviewing and Changing Your Personal Information

We offer you the ability to automatically review and change the personal information you submit to us by logging into the Site and entering the new information yourself. You can change your, email address, password, contact information, financial information, shipping information and user preferences by going to your unique URL assigned to you at: https://yoursitename.screenlight.tv/account. You must promptly update your information if it changes or is inaccurate. Upon your request, we will deactivate your account, contact information, billing information, shipping information and financial information from our active databases unless there is an amount owing to Red Couch. To make this request, sign into Screenlight and click delete account on the settings page. Such information will be deactivated as soon as reasonably possible based upon your account activity and in accordance with the status of your account. For greater clarity, so long as there is no outstanding amount owing in your account it will take no more than 30 days for the foregoing information to be deleted entirely from our backup servers, however we make no further use of this information as set out herein or otherwise once you deactivate your account.

We will retain in our files some personal information you have requested to remove to prevent fraud, collect any fees owed, resolve disputes, troubleshoot problems, assist with any investigations, enforce our Terms and Conditions and comply with legal requirements as is permitted by law. Therefore, you should not expect that all of your personal information will be completely removed from our databases in response to your requests. However, such personal information will be deactivated from public and registered user viewing and will only be available to Red Couch employees.

Under the General Data Protection Regulation, you may be entitled to specific provisions, including: (i) the right to withdraw consent to processing where consent is the basis of processing; (ii) the right to access your personal information and certain other supplementary information, under certain conditions; (iii) the right to object to unlawful data processing, under certain conditions; (iv) the right to erasure of personal information about you, under certain conditions; (v) the right to demand that we restrict processing of your personal information, under certain conditions, if you believe we have exceeded the legitimate basis for processing, processing is no longer necessary, or believe your personal information is inaccurate; (vi) the right to data portability of personal information that you provided us in a structured, commonly used, and machine-readable format, under certain conditions; (vii) the right object to decisions being taken by automated means which produce legal effects concerning you or similarly significantly affect you, under certain conditions; (viii) the right to lodge a complaint with data protection authorities. 9. Other Information Collectors

Except as otherwise expressly included in this Privacy Policy, this document only addresses the use and disclosure of information we collect from you. To the extent that you disclose your information to other parties on our Site or other sites throughout the Internet, different rules may apply to their use or disclosure of the personal information you disclose to them.

10. Security

Your personal information may be stored and processed in any country where we have facilities or in which we engage third party service providers. By using the Site, you consent to the transfer of information to countries outside your country of residence, including the United States, which may have different data protection rules than in your country. While such information is outside of Canada, it is subject to the laws of the country in which it is held, and may be subject to disclosure to the governments, courts or law enforcement or regulatory agencies of such other country, pursuant to the laws of such country. However, our practices regarding your personal information will at all times continue to be governed by this Privacy Policy and, if applicable, we will comply with the GDPR requirements providing adequate protection for the transfer of personal information from the EU/EEA to third country.

Red Couch uses procedural and technical safeguards to protect your personal information against loss or theft, as well as against unauthorized access or disclosure, to protect your privacy, including firewalls and encryption. We employ many different security techniques to protect such data from unauthorized access by users inside and outside the company. However, "perfect security" does not exist on the Internet. If you believe your personal information has been compromised, please contact us as set forth in the “Accountability” section. If we learn of a security systems breach, we will inform you and the authorities of the occurrence of the breach in accordance with applicable law.

Please revisit this page periodically to stay aware of any changes to this Privacy Policy, which we may update from time to time. If we modify the Privacy Policy, we will make it available through the Site, and indicate the date of the latest revision, and will comply with applicable law. Your continued use of the Site after the revised Privacy Policy has become effective indicates that you have read, understood and agreed to the current version of the Privacy Policy.

Red Couch is responsible for personal information under its control and has designated a Privacy Officer to be accountable for Red Couch’s compliance with this Privacy Policy and applicable laws.
